New Orleans Police Issue Arrest Warrant for Cuba Gooding Jr.

New Orleans police issued an arrest warrant for Cuba Gooding Jr., the Oscar Award-winning actor, after he allegedly pushed a bartender at a French Quarter business early Tuesday morning.

Police said Gooding, 44, was at a business in the 200 block of Bourbon Street about 3 a.m. when other customers began to ask to take pictures with him. Police did not specify what business Gooding entered.
The bartender told police that Gooding became “aggravated” with the other customers and pushed her away with an open hand when she approached him and asked him to calm down, said New Orleans Police Department spokeswoman Remi Braden.
Another employee called 9-1-1 and then told Gooding that the police were on the way. Gooding then pushed the bartender a second time and left the bar.
Gooding faces a charge of municipal battery, Braden said.
Gooding is in town for the filming of the movie, “The Butler.”

The Fourth Amendment of the U.S. Constitution protects citizens against unreasonable searches. The amendment applies to government agents, like police officers. It does not apply to searches by private individuals. This protection extends to automobile searches, but it is not absolute. However, if a court finds that evidence was taken during an unlawful vehicle search, the court will not allow the prosecution to use that evidence.
Searches and Your Expectation of Privacy
A “search” can occur when a governmental agent intrudes in an area where you have a “reasonable expectation of privacy.” Deciding a “reasonable expectation of privacy” involves two questions. First, did you have an actual – meaning subjective or in your own mind – expectation of privacy? Second, would the subjective expectation of privacy be reasonable to an objective, uninvolved person?
Consent to Search
In certain situations, you may refuse to let a governmental agent search your vehicle. The agent is not required to inform you of your right to refuse. If you agree to the search, it must be voluntary – meaning you weren’t under pressure to comply. You also have the right to limit where the agent can search – the trunk but not the glove box, for example. You are free to change your mind at any time, even after the search has started.
Probable Cause to Search
A government agent with probable cause can search your car without you agreeing. Probable cause means a reason to believe the car more than likely contains evidence related to a crime. A routine traffic stop can develop into probable cause to search the vehicle. After pulling a car over for a traffic violation, a police officer might notice that the driver matches the description of someone suspected of stealing parts from automobiles. The officer also notices automobile parts in the back seat. These additional facts most likely create probable cause for the police officer to search the vehicle.
Search Incident to Lawful Arrest
When a police officer makes a lawful arrest, the officer may search not only the arrested person but also the area immediately around the arrested person – like the car the person was traveling in just before the arrest. However, this only applies if the person is arrested. If the driver is only given a traffic ticket, the police officer cannot search the vehicle. If a police officer has the choice to either issue a ticket or make an arrest, the officer must make the arrest in order to search the car.
The law surrounding searches of vehicles is complicated. Plus, the facts of each case are unique.

Louisiana state police and local law enforcement agencies are telling motorists to clean off their dirty license plates. State police say in a news release the motorists caught with their license plates obscured in any way, including by dirt, mud or frames that cover part of the plate, could be ticketed.

Louisiana law requires vehicle license plates be clearly displayed, as well as illuminated at night by license plate lights. Col. Michael Edmonson, state police superintendent, says clean license plates can help citizens more easily report reckless or impaired drivers, as well as vehicles involved in criminal acts.

Penn State Sex Abuse Scandal Inspires New Laws In Louisiana

Penn State University sex abuse scandal has resulted in new laws in Louisiana to penalize those who fail to report allegations of child sex abuse and protect those who do.
One measure protects whistleblowers who report child sex abuse from employer retaliation, while two others penalize those who fail to report to law enforcement. A fourth adds certain classes of athletics coaches to the list of individuals required to notify authorities if they suspect child sex abuse.
Under previous Louisiana law, child care providers, members of the clergy, mental health workers, elementary and secondary school teachers and others listed in the state children’s code were required to report any abuse or neglect they encountered. But if you were an average citizen and discovered child abuse, the law did not force you to report it.
Now, no matter who you are, if you see a kid being sexually abused, you have an absolute, ironclad responsibility to report that to the legal authorities immediately
Adults who fail to report it could face up to five years in prison or a $10,000 fine if convicted. This is a felony.
One lawmaker who sponsored the measure mandating that coaches report any signs of sexual abuse has said he found the facts surrounding the Pennsylvania case so offensive that he had to come up with a way to strengthen laws that protect children.
“That’s where this piece of legislation really came from; it was a reaction to that and the desire to make sure that our laws were strong enough to protect our young people,” he said.
These laws will go into affect August 1, 2012.

On August 1, 2012, HB 47 will go into effect. This new piece of legislature provides for a mandatory 30 day sentence in Parish jail for second time offenders when the offense occurs within 1 year of the 1st. The offender will also be required to participate in a court ordered substance abuse program.
The sentence of 48 hours will remain for second time offenders who are arrested for a DWI a year or more after the first offense.
