Aggravated Assault with a Motor Vehicle Upon a Peace Officer — La RS 14:37.6
A. Aggravated assault with a motor vehicle upon a peace officer is an assault committed with a motor vehicle upon a peace officer acting in the course and scope of his duties.
B. For the purposes of this Section:
(1) ”Motor vehicle” shall include any motor vehicle, aircraft, watercraft, or other means of conveyance.
(2) ”Peace officer” shall have the same meaning as defined in R.S. 40:2402.
C. Whoever commits the crime of aggravated assault with a motor vehicle upon a peace officer shall be fined not more than five thousand dollars, imprisoned with or without hard labor for not less than one year nor more than ten years, or both.

Aggravated assault with a firearm is an assault committed with firearm.
“Firearm” is defined as an instrument used in the propulsion of shot, shell, or bullets by the action of gunpowder exploded within it.
Whoever commits an aggravated assault with a firearm shall be fined not more than $10,000, or imprisoned for not more than 10 years, with or without hard labor, or both.

Aggravated assault upon a peace officer with a firearm is an assault committed upon a peace officer who is acting in the course and scope of his duties with a firearm.
Whoever commits an aggravated assault upon a peace officer with a firearm shall be fined not more than $5,000, or imprisoned for 1 to 10 years, with or without hard labor, or both.

Assault By Drive-by Shooting — La R.S. 14:37.1
Assault by drive-by shooting is an assault committed with a firearm when an offender uses a motor vehicle to facilitate the assault.
Whoever commits an assault by drive-by shooting shall be imprisoned for 1 to 5 years, with or without hard labor, and without benefit of suspension of sentence.
“Drive-by shooting” means the discharge of a firearm from a motor vehicle on a public street or highway with the intent either to kill, cause harm to, or frighten another person.
Assault by a drive-by shooting is a Crime of Violence under La Revised Statutes.

Aggravated assault is an assault committed with a dangerous weapon.
Whoever commits an aggravated assault shall be fined not more than $1000 or imprisoned for not more than 6 months, or both.
If the offense is committed upon a store’s or merchant’s employee while the offender is engaged in the perpetration or attempted perpetration of theft of goods, the offender shall be imprisoned for not less than 120 days to 6 months without benefit of suspension of sentence and may be fined not more than one $2000.
